I. Scope of Work Commissioned

Artist and Client expressly agree that the artwork to be created by Artist pursuant to Client’s specifications shall be limited to, unless modified with consent and knowledge from both parties, the following artwork, hereafter known as “the Work”:

Artist agrees that the Assets shall be of first class quality, artistically produced, with aesthetic content technically correct and of a quality equal to current standards for Assets of similar character and purpose.Complexity of the Work will factor in the quote of the commission, this will be based on the digression of the Artist after viewing the Final Thumbnail and Sketch. If the work is subjected to complexity, the Artist will inform the Client of the Complexity Fee and will be added to the final billing.

The Client can avail five (5) minor changes to the initial Thumbnail and Sketch. Once the Thumbnail and Sketch has been approved by the Client, Additional fees of $10 will be charged for revisions that are not due to any fault on the part of the Artist, and for revisions reflecting a new direction to the assignment, or new conceptual input.

Below is a list of subjects that the Artist CAN and CANNOT do. (Please keep in mind of my artstyle when ordering. I cannot promise you the best of quality of subjects outside my capabilities)By commissioning any NSFW/18+ Work you are agreeing that you are 18 or older

II. Payment

Transaction for the payment shall be done via Paypal for USD and GCASH for PHP only. Information of the account shall be provided after accepting the initial Work . (Please make sure when sending a transaction to 'choose someone you trust/triends' to lower the deduction fee. Or, if possible to compensate for the fee of $5 :( that would be much appreciated)The Client will be given 24 hours to pay after final Thumbnail and Sketch has been approved ora a quote is given. Non-payment within 24 hours will result to complete termination of the Work. Progress up to this point, if any, will be repurposed as a YCH.It is the Client's responsibility to inform the Artist when the payment has been sent. Sometimes a payment will not fall through and I will know of it. If the Client fail to tell that they have sent the payment within 24 hours - and the Artist is absolutely aware that they have not received the payment - then the term stated above will apply.The Artist will only begin once the payment is settled. The Client can hasten this by confirming the receipt for the transaction, this is located in your list of original transactions under the Activity Tab of you Paypal account (browser)

III. Deadlines and Completion

Upon receipt of Client’s specifications pursuant to Section I, which Client agrees are true and complete at the time of execution of this Agreement, Artist agrees to complete the Work on or before the due date provided agreed upon after the final Thumbnail and Sketch has been consented by the Client. The deadline begins only after the Artist has received the full payment.Estimated time of completion may take from 3 days to months.The Client may request WIPS of the Work but are not allowed to share in any way or form, nor will the WIP be used and altered.If the Artist fails complete the Work on or before the said due date, the Artist will inform the Client of the causes and will be provided grace period.

IV. Copyright / usage policy

Artist and Client agree that the following rights shall be transferred from Artist to Client upon receipt of full payment.Client agrees that the work is STRICTLY for personal use only and perpetuate Non-commercial use (e.g. selling, modifying, merchandising, altering, create derivative works, etc.) of the Work of the Artist. The Client may not claim the Work as their own.The Client has permission to repost the Work wherever they would like, as long as proper credit is given with the LINK of any social platform of the Artist and the watermark/ signature remains intact and unalteredIf the Client breaks the copyright infringement in any way, every right the Client had to the drawing will be retracted and will be privately blacklisted from commissioning me and reported

A Purchase of Commercial rights to the Work will start from 200% of original price.
With commercial rights the Client is allowed to make any sort of merchandising with of the work. Usage in prints, books, covers, props, change it the their liking and promoting your own brand with.
Credit is still required for usage of the Work, even if altered and editedPrivate Commissions always come with a 50% Fee

V. Artist's Right to Authorship Credit

Artist may use Work in Artist's portfolio (including, but not limited to, any website that displays Artist's works). When asked, Client must properly identify Artist as the creator of Work. Client does not have a proactive duty to display Artist's name together with Work, but Client may not seek to mislead others that Work was created by anyone other than Artist.

VI. Termination/Kill Fee

Client may not terminate this Agreement at any time. If by any reason the Artist is not able to complete the work, full compensation will be returned. Passcode: == ** I like ** ==

VII. Severability; Integration

Client and Artist agree that this Agreement shall not be amended except by a writing executed by both parties, and expressly state that this writing shall constitute a complete expression of the entire agreement between the parties, and that no additional terms exist that are not included herein. To the extent any provision contained in this Agreement shall be found to be void, invalid, or otherwise unenforceable in any way, such invalidity shall not affect the remainder of this Agreement, which shall remain in full force and effect.

VIII. Unauthorized Use by Client; Indemnity

Client agrees to indemnify Artist against any and all claims and expenses, including but not limited to attorneys’ fees and costs, incurred as a result of Client’s unauthorized use of the Work under this Agreement, including the enforcement of this Agreement by Artist.

IX. Release of Liability

Client agrees that it shall not hold Artist or any agent thereof liable for any damages arising from Artist’s failure to complete the Work in a timely manner, regardless of whether such failure was caused by intentional or negligent acts or omissions of Illustrator or of any third party.
